The administration of Trump has sued the social networking giant Facebook on December 3, 2020 while alleging that it gave preference to the immigrant workers who hold temporary visas for thousands of positions instead of the US job candidates. The suit has mentioned that since 2018 to September 2019 the company has discriminated against the workers of the US and has reserved job openings for the temporary workers including the ones who held the H-1B visas.
On the other hand, Andy Stone from Facebook explained that the social networking giant has been cooperating with the DOJ in the problem and while they are preparing for the allegations in the complaint, they cannot comment anything further on the pending litigation. The complaint has been made after an investigation that lasted for two years by the DOJ. The administration of Trump is demanding civil penalties against the social networking giant. The complaint has asked for the penalties as a back pay to what the DOJ has called as Facebook owed to the US workers who were not given employment by the company.
Eric Dreiband, the Assistant Attorney General said that their message to the workers is clear that if the companies do not provide any employment opportunities by Illegally giving preference to the temporary visa holders then the Department of Justice will hold the company accountable. Dreiband added that their message to the employers is that they cannot prefer to recruit or hire the temporary visa holders over the workers in the US.
The complaint has been filed in front of the administrative law judges at the Executive Office for Immigration which is a brand of the Justice Department. The Office of the Chief Administrative Hearing Officer is responsible to handle cases that revolve around the immigration employment practices. Facebook has for the moment preferred to remain silent until it prepares to defend itself in the legal case filed by the Trump administration.
